The Otago Regional Council (ORC) is reviewing how its flood protection assets are protected.


Within the Lower Waitaki area this review has coincided with the Waitaki District Council starting a review of its Waitaki District Plan. Consequently, ORC is preparing a Notice of Requirement for designation of flood control assets that will be included in the District Plan review.

A Notice of Requirement (NOR) is a special planning tool used to protect flood control infrastructure such as the cross banks, groynes and floodways on the Lower Waitaki Plain, or any flood protection assets that the ORC owns or controls on the Lower Waitaki Plain.

The proposed designation would only designate assets that are already included in the current Flood Protection Management Bylaw.

Working together, both the Bylaw and the Notice of Requirement (designation) will act to protect the integrity and operation of important flood protection infrastructure and assets that help to protect people, property and livelihoods from the full effect of flood events. It will control works that occur within designated areas and will mean that people need to talk to the ORC if they intend to undertake any activity that impacts on the functionality of the included cross banks, groynes or floodways.

After we consult with you, and hear your feedback, ORC will update the Notice of Requirement and lodge it with the Waitaki District Council for inclusion in its District Plan. A formal submission and hearing process would then begin. Members of the public will have the opportunity of making submissions at this time.
